Correct. But if you're the giver, you'd want it to be counted as charity anyway, if possible. That deduction is capped at half your income.

I didn't link the annual gift tax exclusion to shnoring, I just corrected the $13k to $14k, to help other ddf'ers keep up with the feds...

Im talking shnorres point of view, it went OT after someone thought that gift tax applies to receiver, It does not. Therefore any income a shnorer makes from shnorrrering from $0 to a billion bucks is non taxable.
They should start taking CC!

Here we go again. It's not really a gift, as this is the recipient's trade, so that's only if they get 501(c)(3) status. Otherwise they must declare it as income. Sorry  :P

I've seen this many times, though they were collecting for organizations. Have you seen this when the person was collecting for himself?

In five recent court decisions the court has ruled that income received from begging are nontaxable gifts. in a reversal of normal roles the beggars contended that the amounts received were earned income because they wanted to collect the earned  income credit, the courts ruled that they were nontaxable gifts.  :P

sorry cant, its in a "Southwestern Federal Taxation" textbook page 5-5. Its one of those "Tax in the news" things that they stick it to make things interesting, they dont supply the cite... doubt they made it up though

It's  T.C. Memo. 1999-317 and through 321. There were 5 prisoners who tried the same thing. They all would get a bit of money from their family, and they tried getting EITC (about 80 bucks of it). The Tax court says money from begging is not earned income, it a gift.

Presumably they got the idea from this case though: Basada v CIR T.C. Memo. 1998-144. Here, the guy was street hustling, panhandling, pimping, and gambling. He earned about 5k, and the issue was whether he is liable for self employment tax--which is only chal if you are engaged in a trade or business. The tax court says he was involved in a trade or business and owed self employment and other taxes on all of it.

So basically, the Basada case and the other 5 conflict, and the tzad hashaveh is that the begger lost. Yah.

From the Basada case: "Petitioner was engaged in street-hustling with continuity and regularity, and with the primary objective of earning an income or profit."

The main point here is continuity and regularity, I think. What does that say for our shnorers?
