Hoping someone can shed some light...
We recently bought a home on Boston, MA. Initial Assessment, survey (needed to determine exact property line) , and appraisal all indicate a carport and garage. Apparently the garage and carport were added some 60 years ago without incident and the home has been through several owners since. About a week ago we received a violation notice for an illegal curb cut and carport. Trying to get any information from the building department has been a complete waste of time. Any suggestions as to my next step? Do I need to hire an attorney?

What happens if neighbor is using part of my property? I have hedges that are like 5 feet from line and neighbor is using 3 feet past hedges that are on my side. Can he eventually claim that part?
In the image, my line extends to the edge of the white fence but the hedges are planted somewhat further back. The line of plantings sort of straddles the line, but he uses the whole area past the hedges. Do I need to do something to lay claim?

Yes,there is definitely a concept of adverse possession...

Might be a good idea to have your neighbor sign something but INAL

Im not sure the issue. If he planted something on your property ask him nicely to remove it or you can remove it yourself.

Adverse possession has so many elements in NY plus the statutory element that its virtually impossible to lay claim based on adverse possession today. Under the old law it was much easier. Once they codified it, it became much harder.

All I can tell you is that i know someone in your town who had to move their (permanent fixture) shed after 10 years when the neighbors property was sold and the new owner insisted on it. Apparently the shed was a few inches over the property line.

3.cbc was much clearer. you throw in statutory elements about claiming adverse possession? am i claiming? is neighbor claiming? i don't know what you meant. like i said. im not a lawyer. but heaven forbid you take my statement at face value. I decided to revisit this thread just for fun and I found a post I made in 2013...

Monsey is the only place I've lived in that had 10x appreciation over the past 30 years and that's because people who buy in Monsey are nuts :)

Happens to be I'm now officially nuts... I bought a house in "Monsey" (Chestnut Ridge) over the summer.
