If he chooses to be mochel (assuming the guy classifies as an oni)  then it is pure tzedakah.

If there is no money to collect, the debt is worthless, what is the tzedaka? If it is under a corporation without shiaabud haguf then there's literally not even a debt.

What if instead of the beis din forcing, it's Tony from the mob? Once a beis din is out of the picture, it would seem less clear if this would count as tzedakah.
Plus, the original transfer of the goods was without any intent for charity.
