I don't get it.
People still sell miles? Don't they know its against the T&C of the airlines and they shut down accounts, ban them for life?

That's exactly the problem with modern society. Ppl are out to make a quick $, and they don't stop to examine the consequences of their actions!

But an LA based, blue and white kippa wearing Kachnik like yourself understands these things better than the youth that our generation has produced.

When we were young we knew that in order to make a living you have to work hard and earn it in a honest manner, sometimes its so painful for me to see how the generations are so drastically derailing the right path.

As for the OP I think his course of action largely depends on the size of money and how badly he needs it. If it is a frum guy it'll be easy to write it off as masar IMHO.

This is OT, but can a 'loan' gone bad b/c the guy couldn't meet his financial obligations truly be considered as tzedaka? (This is relevant to me)
If so, it would seem to be a large loophole since it would allow most loans which turned sour to be written off.
(Do my bad Prosper loans fall under this category?)

Cancelled debt is considered taxable income, and the reason is simple.
So why shouldn't that be counted towards maaser if it is to help that guy recover from his losses? (assuming what he says is true).

I can understand lowering my income by the amount of the sour loan and reducing my tzedakah accordingly, but not writing off tzedaka on a 1:1 ratio for the value of the bad loan.

The debt you forgive him is HIS income, its like you gave him that amount as tzedaka in first place.
+1 I would go so far as to say even if what he says is not true it can still be counted towards masar 1:1 because it is not your job to verify everyone's situation if they say they have no money.

That maaaayyyy be true if he asked for it as tzedaka in the first place, and you simply never verified him. But in this case, he never requested tzedaka. It was a biz deal gone bad b/c he cheated you. How can that possibly be tzedaka?

If he would pay you back on condition you give him back the money as tzeddakah? I doubt that would be an issue.
