I would have agreed with you until they decided to sue the local Rabbanim in secular court. IMHO there are certain lines you don't cross.

They went to court after the Vaad refused to answer their hazmana to Beis Din. Some Vaad members wrongfully believed a Vaad is not required to answer a hazmana and cannot be summoned to Beis Din. It was a big debate amongst the local Rabonim.
The Beis Din (actually two of them) believed the Vaad was required to show up. When they didn't, the Beis Din gave a heter arkoas, allowing it to go to court.
That didn't happen because of the restaurant. It was a result of the Vaad's no show to Beis Din.
That's the (sad) facts.
