Based on my preliminary research it seems like a beis din cannot except schar battalah from one of the sides. See choshen mishpat 9:5 and rambam Sanhedrin 22:9. See Bach on Tur ch"m 9 that if it's given for schar battalah it would only be mevatel the din midrabanan. See igros Moshe ch"m 2:26:3

anyway, it's the same rabbis that let the husbands have the upper hand and use the get as a tool to get what they want - kids, $$$, house, etc...

If all rabbis would require the prenup for all Orth couples before the marriage starts, as endorsed by them (list below) we wouldn't have these problems..
But, then they wouldn't havr their money.... So is it about money or making the balance of husband and wife not just the ketuba, but also an orthodox jewish prenup 8 weeks before wedding :

There are numerous other rabbonim who strongly disagree with this prenup. People who push one way or the other based on "issues" are the ones who lo yehei lo eisek imahem.

The prenup isn't in response to the crazy control freaks -
it's to be in effect and up-to-date for nowadays when there needs to be more balance and not just the husband is in charge of yes or no, but that the husband must pay $150/day after their civil divorce for each day that he withholds a 'get' from the x-wife.

Maybe the correct avenue is to somehow petition NJ/NY to require a get in divorce proceedings for couples who were married under religious law.

I can see this happening.  Not just Jewish, religious in general.

That doesn't make it more valid according to its detractors. I am not referring to the rabbonim who hold of it. I an referring to the amei ha'aretz who push for it on the basis that "there needs to be more balance" and the like and not BASED upon halacha. (I am not trying to call you an a"h especially since I have no idea who you are and your level of knowledge. My point is that the LAST place to be trying to get such a thing accepted is on this forum. Trying to do so is a heoro)

But what about cases where the secular court will force a get when the halacha is that it shouldn't be forced?

That is the biggest obstacle.... otherwise, maybe they should include it in the forced obamacare.....

The secular court won't issue the divorce until the get is finalized.

Would be a nice required addendum onto a marriage license.  Any lawyers around care to chime in? Can't this problem (men being able to legally divorce and not give a get) be solved through religious couples legally agreeing to a get via beis din before finalizing a civil divorce?

No way. Can't have your cake and eat it too.

Why does it have to mean that. The legal court would defer to beis din.
How is it different than binding arbitration?
