Why would he learn from Rabbi E if 90% of people involved never liked him? He had a reputation from before.
I can't talk for him, but someone who's doing shimush isn't always 'learning' what to apply the exact methods. Many times they'll go to get a feel of how things go down in the industry. Regardless, there's much more to every get than the way it was obtained to learn from.
If the lawyers can prove that this was done 100% for the sake of the women, and the judge wants to be lenient. How lenient can the judge be? Is there a minimum sentence for kidnapping?
Everyone knows he has a bad reputation. It just does not make sense to learn from him.
The prosecuter has a lot of discretion in what charges to bring. What they're working for here is to get a good plea deal, I don't think anybody wants this to go to trial.
Why do you think they don't want it to go to trial? It's a great media event.
This is not a slam dunk with a jury.
This is a great case to play on the sympathies of a jury. The account of money involved will pale in comparison to the lawyers of a real messy divorce. With a good lawyer....
IMHO a jury will not care if it was 5k or 500k. We are talking about kidnapping and torture. I am not passing judgment on the individuals just how a jury will look at it.
Whats is the Rabbis defense?Entrapment?....although, they would argue predisposition, so no entrapment?
My bet is they plead guilty and will sit a few years. Remember, a skilled lawyer can influence a jury and perhaps the prosecutor too. The judge, however, has a mind of his own and can impose a sentence greater than what was sought by the prosecutor.
