Hmm, strictly speaking I'm not sure that is true. Sorry for being so technical but yours is a common mistake that people make.
There are two ways an item can be shipped: 1)FOB Shipping point or 2)FOB Destination.
With FOB shipping point, the item becomes the buyers as soon as it ships, the seller then marks it off as a completed sale, and the BUYER is liable for any damages during shipment.
With FOB Destination, the item becomes the buyers when he receives it, THEN the seller marks it off as a completed sale, and the SELLER is liable for any damages during shipment.
In the business world, often these terms are spelled out in the purchase contract but when they are not, it is often assumed that if the buyer pays for shipping it is FOB shipping point and if the seller pays for shipping it is FOB Destination.
However, when a person goes online and buys one item on Amazon for example (as opposed to a company ordering a truckload of goods) even if the seller pays shipping it is usually assumed that it is being sold FOB shipping and the seller is just paying the shipping as a customer service feature. Even though in most cases if the item never arrives, or arrives damaged the company will replace it, that is not because they are required under contractual law to replace it but just because they want the customer to be happy.
