You might want to ask your LOR because

Sounds like borderline miseerah
Asked. He said absolutely assur. Took her name and address out of the return, and I lost a lot of money...

Not disagreeing with psak. However what the babysitter is doing is borderline/absolute stealing. It's 1 thing to steal from the govt but a whole other thing when it directly impacts someone else.

Absolutely agree. She's doing the wrong thing. But I can't let that cause me to do the wrong thing too.

I would let the babysitter know that.

Won't change anything at this point and I'm not looking for a fight. She knows, I asked her if I can have her SS# and she said no...

If she knows how much she costs you....

Also, someone may get a different psak in the future.

I'm specifically using a licensed place next year because the $1,200 savings make it worth it. People should really take that into account when choosing.

The bigger takeaway is that now that he knows how much he is not getting back in credits, he can factor that in to choice of DDC in future. A higher price tag could be cheaper after credits.

I don't think most people would think of going to paper filing in order to bypass entering the EIN/SSN of the provider. Frankly, she may not even be aware that it's possible to do so and have a false sense of security. It would be doing her a favor to let her know.
I'm an optimist; but only because life isn't going to give me any other good choices.

you dont need licensed, only a SS#, name and address
Very often the babysitter is claiming at least some of the income, but still wont give out their info, for all sorts of other reasons, (ID Theft worries etc., Red flag on her return worries.. even if they aren't rational) absolutely borderline stealing. I wonder if the LOR would allow this information to be passed on when asked for a reference. (IMHO yes, if not said maliciously)

Same here, am going to make sure upfront that the babysitter is okay with me reporting. Don't care much for this fight because I'm switching soon for other reasons anyway.

Keep in mind that if you're talking about an in-home babysitter (vs. a daycare) there are withholding tax issues to consider as well.

The employer had withholding, FICA, etc responsibilities as well.

True but good luck getting a SS# or EIN from the basement playgroup next door...

Also, if the numbers don't add up, you can really be getting them in trouble... I don't think it's very hard for the IRS to match the numbers...

And don't forget worker's comp that can bankrupt you if DOL decides you need to have it and you don't!
I've been waiting over 5 years with bated breath for someone to say that!

are you talking about household employees?
Unless the babysitter is coming to your house why would that be a consideration?
The question was about the basement babysitter next door. They are an independent contractor and take care of their own taxes.
Very often as far as Taxes and programs it is very beneficial for them to be claiming at least some of the income and they probably do, to get the EIC, even if they have to pay a bit for SS

Sorry if I wasn't paying attention. I was indeed referring to a babysitter that would come to your home and would be considered a household employee.

you are asking in the wrong section!! Accountants are trained to do accounting and not the government programs.
