They shouldn't be able to do that, since it isn't NY source and I'm not a resident.

But in any event, the states both have setoffs for foreign state tax, and I think the rates are similar.

yeah, I was thinking of that too, you may end up in the same place... though what about 2014... if you owe for 2013, what effect will the payments have on 2014? Will that matter?

Generally the rule is if the kolel gets goverment funding which bmg does then the kolel checks are taxable. They do not count as far as a gain for the eic but rather a loss. Meaning it can only do harm but that's life.

And if the kolel does not get government funding then it's not taxable?

Why does government funding make a difference?
It's better to not be income for eic because if it was, you'd have to pay fica. And most family's in kollel are making 14k (or at least claim they do) to maximize the eic anyway

My employer provided an incorrect W-2 form. After subtracting the various withholdings shown on the form (boxes 2, 4, 6, 14, 17 and 19) from the gross pay shown on the form (boxes 1, 3, 5, 16 and 18 show the same amount), I arrive at an amount that exceeds what I was actually paid. The employer did not respond to requests to correct it. What is the best way to handle this to make sure I do not pay taxes on income I did not receive?

What do you mean by the bold? Where did you come up with the amount actually paid? From the amount deposited in your bank account? Do you have a copy of your last paystub? It should match the W-2.

From what you write about your employer it sounds like he is or will be very soon in big trouble.

I can't pasken for you in hilchus mesireh there are even so much helochs when you are allowed to threaten with misireh but I can tell you that if you take it to the IRS or the labor  department he won't treat you like this.

An employer is required not only to give a pay stub but to make sure that it's in way that the employee understands what is getting deducted.

You better make sure you aren't getting in trouble with him.

Your employer has the same incentive as you to understate income, since he pays his portion of FICA and FUTA.

What do you mean by "other taxable benefits"? Could you give an example?
In this case, the employer is overstating my income and probably paid more FICA and FUTA than if the W-2 would have been correct.

Does he use a Lakewood accountant?
