As a layman i was just wondering that although i understand you cannot dispute the transaction for unauthorized use ,as you gave them permission to swipe but why can't you dispute for goods or services not received. The same way that if you ordered a item online and it never came you can dispute for goods not received (afaik) why can't you dispute that you never received your money .You let them swipe in exchange for money that you never received so you never received what was promised and what the basis of the transaction was -why is that not grounds for dispute ?

Unlike check kiting, which is illegal under nearly all circumstances, laws against credit card kiting are not completely prohibitive of the practice, thereby allowing it to be done to some degree. It is up to the banks to detect the practice and when necessary, stop it.

In order for prosecution to occur in a credit card kiting scheme, a bank must prove intent to deceive. Et seq. reference infers paying credit card minimum balances with credit card proceeds is de facto evidence of deceit."

there is no such thing as "swiping for money" you swiped for whatever goods he swiped, he has to repay you, simple

Not that simple. What did you buy? Do you have an invoice showing what you bought? If it was for services, what services were performed? Do you have emails or texts showing that he would perform services in exchange for this money?

If the perpetrator has already lost his processing capabilities he can (and possibly will) claim this was an agreed upon interest-free loan with the benefit to the lender being free miles and points, which is a violation of the T&C.

Scary thought for those involved, but they can sue sighting financial irregularities in his handling the $$
