Recording reps
« on: January 29, 2014, 10:41:24 AM »
I am not sure where this should be posted. I was thinking that there's a app called tapAcall, basically records phone calls (I am sure there's are better ones w/o fees). What if I were to record convos with citi or hyatt for example were there reps promise something and then they of course say no such thing etc (just a example citi told me even if I have aa card then I can get the executive card and bonus, not saying it's not true but would like to have a little backup). Can I use it against them? How would I go about it? Did anybody ever try this? Do I have to disclose that I'm recording the call to the rep?

You can use google voice for free. It's only for "incoming" calls though, so you have to go to Google voice first and place the call through Gmail/talk.

You can also try to write down the rep's name, date and time. I have had success getting them to pull calls to verify what reps have told me (not just in the world of CC but customer service in general).

Every state has different laws regarding recording phone calls without consent.

I wonder if the fact that they are recording changes anything.

When they tell you "this call may be monitored or recorded" you can just say "same here" ;)

Actually for legal reasons depending on the state they are in there is a consent required in NJ for example to record only one party needs to consent to record in NY you need two parties to consent otherwise you can be prosecuted for wire tapping charges.

I am not a lawyer, I am just repeating what I was told after being in a situation that this type of question had to be asked.

Wife works at Deloitte, she spoke to one of the lawyers there who informed her in NJ only one party needs to consent in NY you need two.

NY and NJ are one party consent states. The question is what happens if reps are located in two party states? Either way, their "this call may be recorded" thing constitutes two party consent.

Right, but I dont think it would work in the opposite direction, by recording the rep yourself. CMIIW
