I purchased $1000 worth of digital camera gear and the seller had very poor pics and a very poor description. He wrote in his listing that he is not a photographer and the equipment is being sold as is. From his terrible pics and description it looked like a great deal and i won the auction. I asked a bunch of questions which he partially ignored and for better pics which he never sent.
Some of the equipment had obvious damaged (corroded batteries) and some of the lenses were so old, pre digital camera days. I asked the seller for a return or a partial refund and he said he will leave it to the discretion of ebay.
I opened a dispute and the "high value claims" department asked me to get repair estimates for each item, and if i do not respond in 5 days they will close the case not in my favor and, "We can allow you more time, as long as you contact us before" and "We will be in touch with you by your registered phone number or by email within 48 hours of the hold time ending.".
I responded explaining that the items had visible damage and to obtain quotes are very time consuming and expensive, so they asked me to provide pics.
I sent pics (on the 5th day) and the email bounced back, then i got an email saying the case was closed and i will not get a refund as I didnt provide documentation by the 5th day.
I appealed the dispute saying that i did get back to them within the 5 days and attempted to email photos as requested and the photos were originally uploaded in the resolution center as well even before they were requested. I got the exact same email back verbatim stating, "... we have reviewed the case... and you didnt provide the documentation by the close date", so obviously they are not reading my emails.

My question is, what luck will i have disputing with amex now?
Will ebay/paypal ban me? will amex cover me?

Sorry for the long post, but i prefer to include details.

I had a listing up for about 6 months.

Today I got an email from eBay that it was taken down bec it violates policy.

How/why did they find this now after 6 months?
Does that mean someone  (my competition?)  reported me?

Firstly Call eBay (As Mark F said)

It could be you replied to the email, which goes nowhere, you have to reply to the case in the resolution center via eBay.

You should be able to have the case re-opened.

If eBay will not help you, I would suggest opening a Paypal dispute first, as you have only a certain amount of days to open a Paypal dispute, and if they won't help you, then file an Amex claim.

With Amex you should win, but keep that as your last resort.

It could be either someone reported you, or it took the eBay system a while to pick it up?

What Policy did it violate? Did you use copyrighted pictures?

Why amex as a last resort?
Ive already spent hours back and forth writing emails to ebay and they are not helping. And if amex will cover me (and I get to keep the items) why not go with them?

Cuz once you dispute with Amex, I do not think you will be able to dispute via Paypal.

I bought something that turned out to be faulty, seller ignored my emails, and ignored the case, I won, returned it and got refunded. Seller just left me a bad feedback that I am a scammer and to beware etc, (for some reason he left a "positive" feedback but with all this scammer beware wording ??) Would ebay remove it, if I explained to them that he did not respond to the case etc?

I don't know the answer to your question,  but the reason why he left "positive"  feedback,  is bec the seller  can't leave negative feedback.  Only the buyer can.

Thanks all for the advise to call ebay, although i wasn't interesting in dealing with them again.
I called and they explained how the initial deadline still was in effect being that i didnt request it to be extended, and i should have called etc or requested an extention, but she did say the rep assigned to my case would reassess it even though they dont usually allow a second appeal.
Bh i just got an email back saying she will make a manual correction for a full refund :)

So i guess i dont need to send the stuff back either?

Nope, you wont. If money is coming from eBay, not the seller, there is no reason the seller should get the item back

Im returning something I bought on ebay , seller agrees.
I printed a label on paypal for "flat rate envelope" but could I put it in a padded flat rate envelope?
I didn't see that option in paypal.

Padded flat rate costs more.
