I agree that he's better off doing it with a friend.

If he pays with a CC and then cancels the sale I believe they will refund the money to PP without deducting the fees.

interesting ebay problem

i bought a (used) cell phone on ebay. it was shipped in a padded manila envelope. when usps handed it to me i realized that it was half open (as if someone had slit it open). there was nothing in the envelope. i quickly pointed it out to usps so they scanned it and took it to show to their supervisor.

what should i do? should i dispute with paypal right away? call amex? wait for usps to get back to me (if they even will)?

Does USPS show as delivered? If yes eBay is going to give you a hard time.
Your best bet is Amex.

I bought an item on eBay recently. After 3 weeks no show I opened a case. After the buyer didn't respond I esclated the case. Ebay then tells me to wait another 10 day.

I was fed up, I filled a dispute with Amex, instantly I was refunded.

On day ten the buyer finally ships.... I contacted Amex that the item came and since they refunded me where should I mail it to. They said they will advise me. A few days ago I got a letter saying the case is closed....

Free  item!

currently still shows as out for delivery. i handed it right back to her and she scanned it that there was a problem and took the package back so i doubt it will say delivered.

That would be a bit difficult, Amex will close any disputes open with paypal. (or at least thats what their website says)

As far as eBay/Amex is concerned you never recieved your item. The seller is responsible until it reaches your hand. I would not have qualms disputing it on eBay.

this is a stolen item issue. You should file a claim on eBay ASAP and get the money back thru them. Or even paypal. I've had very bad experience with Amex via eBay in the past
