As a Brisker you should know the difference between 'not received' and 'refused'.  :) :)
 Not the same in ebay/PPs book.

Well even if it was refused, its not worse than a return.

What was the return policy stated?
it wasnt refused. it was an empty package. my point just is why should the seller take the hit if someone from usps stole it and i can just get my money from amex. (policy was no returns)

Forget about the seller. Besides that sellers can be crooks too, @Name Changed recently posted that he had recently,  where a  seller ship him an empty package for a $500 phone.   

You don't owe the seller anything. As far as you are concerned you never got your merchandise, and that is what eBay buyer protection is there for.

The reason to handle with eBay PP first, is because that is the proper way to go in such a situation.

No need to make assumptions as to what may have happened, and who may be losing. Do what you need to do.

update.
i did open a paypal/ebay dispute against my better judgement yesterday. did not get a response from the seller yet.
HOWEVER usps delivered my phone today. they found it. it fell out of the package.

its possible that the postal worker who was supposed to deliver it was going to steal it but i noticed. but i dont think so. she didnt seem to be lying or nervous at all both times when i spoke to her. what happened was it was delivered by the regular house to house worker. she said she found the cell phone in the cart she pushes. at first she thought it was a coworkers but then she remembered that i had an open package. so it was delivered today with an apology note from usps.

condition is fine. it didnt fall to the floor just slipped out into the bag.

Its interesting how this whole thing ended :)

I happen to find USPS pretty honest, a pain to deal with, but they aren't stealing your packages. In items I shipped to other countries, I had a few times that the box was opened, and items stolen.

Cud be tampering with USPS mail is a federal crime...

@OP - one thing I am wondering, why were you so concerned about the seller loosing out, and not about Amex? Its the sellers responsibility to insure the package, if they don't, that's their risk.

amex offers a protection as one of the benefits of owning the card. i dont feel bad if i have to use it. the seller was a first time seller (only a buyer in the past). s/he didnt know to take out insurance. i feel bad if it wasnt their fault (especially when i can get the money somewhere else)

i had two cases recently where i shipped internationally and in both instances the buyer claims he never got it and the tracking shows it was scanned last in white plains ny. (one opened a case after 45 days where ebay refunded him and removed it from my record-they took the hit. yet) in the second case he asked for money back after 17 days.
what do you guys advise? i didn't have any insurance, filed a complaint with usps and they said they would look for it...any way to recover the lost? do i have to issue a refund?

Do you have full tracking on the package, that will show delivered when he gets it? If so then just upload the tracking and hope for the best. Be sure to mention in the case that it takes a lot longer than 17 days for international delivery.

If you don't have full tracking (with delivery scan), then persuade the buyer and eBay that they need more time for delivery since it is international. Try to show them any proof you have that you shipped it to the right address, and the date shipped (i.e. receipt from post office, or screenshot of online shipment receipt/endicia etc.). In a case where there is no full tracking, and the buyer still says he never received it, you will probably lose the case. Bottom line is - tracking is your only proof of shipment/delivery. Always use it when it's cost-efficient.
