ebay sales tax

i am selling an item on ebay and (the would be buyer)was suggesting that since he lives in ny as i do he needs to pay tax i never charged tax but i did a quick search and saw that (i think)technically i am supposed to charge  my question is do i need to charge tax if yes what do i do with it

I don't have an answer to your question,  but if you're just trying to answer up to the buyer, yiu can tell him that you'll be paying sales tax even though you're not charging him.
In other words - you're taking the hit as opposed to passing the charge on to him.

Just make sure he doesn't work for the IRS  ;)

You only are allowed to charge tax if you are a registered re-seller.

Besides, if that guy wants to pay tax he could just pay to his state, he doesn't have to go thru you.

Alternatively, you could make up some code provision in the NYS revenue code which will say that your sale isn't covered.

And in fact, there is no way he is supposed to pay sales tax on that. If I sell you my lawnmower, there is no sales tax. The reason is not that it is impossible to track; the reason is that casual sales don't have sales tax. That is why only registered sellers have to pay sales tax, because they are running a real business of it.

Not totally true.

From what I know of in NJ, buyers are responsible to pay sales tax on everything they buy. IIRC its called use tax. The buyer is the one responsible to pay it.

In NY its the same thing.
If you buy something out of state and the the seller didn't charge you sales tax, you must fill in line 59 in your NYS return and pay yourself the sales tax.
