Sold a cellphone from Samsung deal a few weeks ago. Guy claimed empty box. I paid USPS insurance Priority etc. He opened claim and eBay refunded and closed case. I'm out phone and money. Filed claim with USPS, waiting on that. Bought phone with Chase Ink Plus. What recourse do I have? eBay is the worst.
Shouldn't the USPS insurance cover it? If not that scares me, as I always buy insurance on very expensive items I ship, but never had a problem, if they do not pay then what is the benefit of buying insurance?
I'm fully expecting them to say that they delivered an undamaged package and dont know that I put anything into it. I'm beginning to suspect it was the post office personnel because they "helped me" seal the box and saw that i insured it. Have a Postal inspection service buddy who has initiated an investigation.
Post office says the buyer must deliver the packaging for me to get paid. He threw it out. How did I even get into this mess. If I have to sue this will not be fun.
thats a pretty silly rule . why would the buyer do anything for you if hes the potential thief?
File a report with Postal Police for mail fraud see if that scares them into doing the right thing
Does the Ink Plus have purchase protection for lost or stolen items? If so, claim from them.
Selling an item on eBay and got a request to send a PayPal request. Is there a reason for me to be scared to do the sale outside of eBay? And doesn't PayPal have protections as well?
Done. $500 limit. So I'm almost made whole if they pay.
Why aren't you getting credit for the final value fee?
They pay for stuff that was lost or stolen while in the hands of a shipping carrier?
Who you going to sue?
Probably USPS 4 failing to honor the insurance contract that we had. The receiver is not under my control I have no way of forcing him to produce the package I paid for insurance the insurance should cover they're denying coverage based on the addressee not cooperating. And they delivered it to an individual other than the addressee and to a location other than to where it was addressed specifically a different Suite
Have looked at the T&C's? IIRC the package is required for loss or damage if they ask for it. Either way good luck with suing them.
