I assume he is trying to avoid the ebay fees, as there is almost no way to avoid paypal fee and have it to be a safe transaction

Never have such messgaes thru ebay messaging. Ask the buyer to conact you at your email using "dot" and "at".
Ya, ebay doesn't let you send them your email address in their attempt to force you to only correspond through them!!!

I was trying to contact a buyer once off ebay and I remember having issues giving them my email address. Using 'dot' and "at" made me feel like I was giving off a shady appearance!

If you have good feedback as a seller - I wouldn't think its too shady ... But when someone wants a discount I dont think they are worrying about email address looking shady

Good Points. Also, buyers dont really chap the matzav about all the fees. The dont know what you are aiming at...

i havent used ebay much but i think there are safer and ways (and allowed by ebay)

Wasn't such a complicated question. You stated the are leagal ways to get around fees. So I am asking you like how?

I'm looking for some advice in regards to a recent ebay sale.

Here's my story; I sold a prepaid phone on ebay. The buyer - who buys and sells cellphones - paid for the item right away and I shipped it the same say.

A few days later he emails me that he cannot active the phone bec it is coming as lost/stolen.

I asked him for the meid/serial number, and he had no problem giving it to me. I then called Verizon and they said there is no problem with the phone and it is not on any lost/stolen list.

I told the buyer to try again to activate the phone and he claimed it still wasn't going through.

He sent me a threatening email that if I don't accept the return he will forced to file a dispute with ebay.

Today I received the returned phone. I tried activating it and it worked perfectly! I didn't refund him yet.
The package is ripped open and I can't resell it.

My question is
1) How should I go about this?
2) I suspect that he possibly stole some info from the phone (meid number or other programming numbers ) and he never really needed the phone in the first place. 

He's a phone dealer and that's why the whole story is very shady.
Any advice would be appreciated.

Saver2000 - He is going to open up a case, and of course ebay will side with him, if he can proove that he mailed it back. That is ebay! Gotta live with it.

Yup. He opened a case today I refunded him bec I knew anyways I would lose and I don't want it on my record. 

It  was a small amount, but now I'm left with a prepaid activated phone in open package - basically worth a lot less than it was worth before I sent it to him.  :(

Yup, thats basically ebay in a nutshell ;) You gotta sell enough stuff to be able to take the loss from these type of cases ...

I am wondering, if the people doing these scams buy specifically from people that dont sell a lot on ebay, or they'll  buy from anyone?

Why would they davka buy from such sellers? What does it make a difference to them?

I am thinking possibly ... But dont know, These scams are mostly with cell phones... I have heard other people that had this issue, I never have only sold a few cell phones in years, and this never happened to me...
