He opened a case and I responded by requesting he send the item back for a refund. I messaged me saying that he paid for a return label and is asking me to pay for it.
Technically you do not have to pay.

But he could escalate the case, and eBay will send him a label.

If you dont want him to escalate it, then offer to pay. But as usual the buyer is in control

If I pay and he doesn't escalate, does my rating get affected at all?

No

A buyer is returning something I sold claiming item is not as described.
Who is responsible for return shipping?
Was the item really not as described? If it was, and the buyer just masses around with you, I'll tell you what my friend did when he has a case like this, (he was very mad on the buyer.....) when he received back the item, he took a hammer and smashed it..... then he took pictures and went to the PD to make a police report, he faxed in all the pictured and EVIDENCE to eBay opening a case that the buyer sent him back the item defective.... to make a long story short he won the case, eBay refunded him all the money, removed the typically bad feedback from the buyer, and sent a private email to the buyer "NEXT TIME MASS AROUND WITH SOMEONE ELSE"
You can say what you think when you think what you say.

It was an unlocked Verizon iPhone. Buyer wanted to use it with ATT. Obviously, it didn't work so he claimed it wasn't unlocked.

I don't think I'd file a false police report for a $300 phone.

Very stupid to send the email if he filed a false police report ect.

Either way - as a seller its fair to the buyer to offer a return policy.

In most cases, item not as describes is for used items, often the buyer is hoping it is in better condition that what it described to be in.

I sold thousands of items on eBay, and I could count the amount of returns I had.

Depends on how it was listed. I would assume it was an iPhone 4S (as 5 and 5S work with ATT, and 4 and older dont have a SIM slot)

If the description said unlocked, its somewhat assumed it should work with any SIM card, unless otherwise stated.

I was thinking the same, but by saying on email DON'T SCREW ME it can mean that don't brake my stuff and send it back to me.......

Also a return is fair when the buyer pays return shipping, when the buyer is saying item not as described (when in fact it was) just to get the seller pay for his shipping he is worth what he got.

His tayveh for netzuchen probably pushed him to do it. But then again we all know the truth so we see the email as he is saying "look how I fooled you" but technically it doesn't mean anything....

The only think I can tell you is His tayveh for netzuchen

Or I don't remember exactly the end of the story (he told it to me over 2 years ago when I wasn't thinking I will be selling my self, so I didn't really mind collecting every detail)

Correct.
The description specified factory unlocked, I forgot to write Verizon.

I sold an expensive item on ebay.

I would like to hand deliver the item.

The problem with that is, I wont have proof of delivery.

How do I go about this?

I sold a very expensive item $5k+ and a guy bought it the buyer has 0 feedback but bought a item in 2008 got feedback and his acct is open since then. Is it risky to ship to him? Even if I put insurance on item and he pays PayPal etc...
