I don't think there is a set speed
depends on the cop, area that you are driving, speed of other motorists, etc.

Don't quote me on this but:
It's usually charged as vehicular manslaughter and in order for that to happen, the driver has to be found guilty of reckless/negligent driving... that part differs by state. In some states it's as little as 20 mph over.
