Sq T&C state you can't use it for cash advances. Since the card is being charged to obtain cash, I believe this falls under that category
...but would you consider it illegal?

I ain't no lawyer! Its definitely not a crime. Probably is a breach of contract. The reason these regulations are in place is to avoid an endless credit cycle where people pay off credit cards with other cc's. Which is why ATM's carry a cash-advance fee.

its not exactly like a cash advance since its a gift card which is aleady loaded its more like a debit card. Although you can load it with w cc so it isn't exactly the same...

when i first got it i did 2 swipes for 4500 and i did not get charge a fee maybe its a fluke or mazal or what but i did not get charged a fee now i use it almost daily and i make my customers pay the fee

-In order to make a MasterCard purchase, the merchant/retailer required a minimum or       maximum amount.
-The merchant/retailer is adding a charge for using your MasterCard card.
-The merchant/retailer required identification.
-A merchant/retailer displaying the MasterCard decal in their window refused to accept       my MasterCard card.

did you buy the square in a store ? If yeah then I think they waive the first few dollars of fees to compensate for the purchase price,although that wouldn't explain all the fees they missed

under the "Is Square available in my country?" article it says that "Please keep in mind that while we do support some internationally issued cards, we do not support payment processing outside of the US." 

does that mean that if i try processing a payment from an american cc on an iphone in israel it won't go through?    neone with experience?

If you have the blue cash preferred then any gift card you buy at a grocery will get you 6% cash back
