Executive amnesty
« on: November 20, 2014, 03:10:32 PM »
Obama is poised to grant amnesty to about five million illegal immigrants tonight via executive order.

I'm trying to understand this action from a nonpartisan point of view. My understanding is that those granted amnesty will NOT become citizens, which means they will not have the right to vote or collect benefits from government programs, such as EBT, Medicaid (or free Obamacare), wealfare, section 8 etc. Rather, they will only be granted legal working papers, which [basically] means that they can legally work at the jobs they already have.

So, for example, your cleaning lady, the guy who delivers stuff from your local grocery, or the guys laying the bricks at that new construction site can now be "on the books" if he or she chooses.

This leaves three problems for the opposition [the GOP] to be upset about:

  • This sweeping executive action is unconstitutional and is not within the president's power to grant.
  • There will be more competition for existing jobs which are already difficult to obtain as it is.
  • There will be an influx of illegals sneaking into the country now that they believe they can get amnesty

What am I missing here?

There's nothing unconstitutional about the executive declining to deport people.

There's also nothing unconstitutional about the executive not prohibiting people from working.

The question is not his passively not prohibiting. The law already prohibits them from working. The he would need to actively issue a permit which was not authorized by congress.

The assertion by OP was that the executive action is unconstitutional. It's not unconstitutional. It might be illegal, but that's not the same thing. On top of that, 8 C.F.R. 274a.12(c)(14) allows deferred action aliens to apply for work permits. The executive action makes the classes of aliens Obama discussed into deferred action aliens.

Wrong. They are doing jobs that nobody wants because they don't have work permits. Your cleaning lady can now get a union job like school, hospital or park maintenance and work for the city or the State. Your delivery guy can now get a factory, automotive or mining job. They can work at fast food chains. Not only that, but they will do it for far less pay than the current American workers.

I didn't assert anything. I simply stated the claims made by those who oppose amnesty.

And they will be more than happy to take minimum wage, unlike the current workers. This is the biggest gift to the fast food industry!

They will be happy to take minimum wage until they think they can get more. Around a month or two.

I thought we need to raise the minimum wage because there are so many people not earning enough to live on.

What will happen to all those who will need to either take a pay cut or lose their job?
