Bank gave extra credit by mistake, how far do I need to go?
« on: January 27, 2015, 02:05:19 PM »
Long story short, my wife had fraudulent activity on a debit card.
We called discover who issued provisional credits for all fraudulent charges, but then they retracted most of the credits because I didn't send in an affidavit (that they never asked for), and a few of the refunds became permanent credits.

When I did send in the affidavit listing the total amount defrauded as requested on their form, as well as a bank statement with all fraudulent charges marked, they proceeded to issue a single credit  for the total amount of all fraudulent charges -- some of which had already been correctly credited.

I sent them an SM explaining what had happened:
Quote
Hi,I submitted an affidavit testifying about fraudulent charges that had been made on my account by mail, and on x/x/xxxx I received a credit of $xxxx.xx which was the total amount for all the fraudulent charges that were made.I did previously receive reimbursement for some of the charges -- actually all of them were reimbursed with provisional credits but most of the provisional credits were reversed -- and I believe that if my calculation is correct, the amount that remained to be refunded was $xxx.xx which means that I received an extra $xxx.xx in the credit on x/x/xxxx. Of course I would be happy to keep the additional credit :-) however I felt it would be proper that I point out the apparent miscalculation so that there are no misunderstandings.Thank you for your help.
Sincerely....

They resonded:

Thank you for contacting us about your Discover Bank account.

Thank you for your message, upon review of your Cashback Checking account ending xxxx, I am showing a credit for disputed items in the amount of $[total amount defraded], In order to assist you with this matter I will need to advise you to contact our security department for further review of your account, please call 1-800-450-7067. Agents are available from 9 AM to 5:30 PM EST Monday through Friday and 8 AM to 12 PM EST on Saturdays.

We appreciate your business and the opportunity to be of service.

Thank you for choosing Discover Bank.

Sincerely,

I feel like I did my bit, and am not interested in more phone calls with their so-far-not-so-impressive CS dept (ulike disc CC who have been excellent IME) and waiting on hold. I told them about their error and gave them the chance to rectify it.
I am not looking for moral/halachic rulings here, B"H I have a very competent Rov who has outstanding yiras shomayim and clarity of mind. I know many on here do too, but he already got the position, so sorry about that :-).

My question is, if I let it go and do not force the issue of the additional $194.32 credit that they issued, are there likely to be any repercussions?
I pointed it out to them, so I obviously did notice that it happened, but I also made an effort to correct the situation and they wanted more effort that I dont feel inclined to invest.  Because this credit was applied as a one time single credit -- probably by the person who read the affidavit I sent in and did not look up my bank account records --as opposed to the original provisional credits that were linked to the original charges etc. I doubt it is likely they will ever pick up on it.

Thoughts?

On further reading, I would say that if push came to shove they told you to call, so you should likely do that so you can say that you did what they told you to do. I wouldn't waste a ton of time on the call though. Perhaps record the call in case you are on hold for a long time and it gets ridiculous and you have proof of such.

Isn't it DDF policy to go off topic? In that case, we're perfectly on track!

I think there's room for deniability.  You made the effort to  return the refund.  When you got the reply, you were too busy to call and then you forgot about it.

This situation reminds me of the 'Bank Error in your Favor' card in Monopoly.  The question is are you concerned about a future clawback or that it just doesn't seem right?

Concerned about ramifications. They said in order to assist you I would advise you to call… I am not looking for assistance I reached out and they didn't seem overly concerned.

I wonder what people who type "u" instead of "you" do with all their free time.

Since you obviously are questioning what you should do, I would just make the phone call and be done.

Most banks would just send you a check without asking questions.

If you attempt to send a check to a bank they will probably not know what to do with it and just return it
