Companion Pass lawsuit against Southwest

Unhappy Rapid Rewards member sues Southwest Airlines over the companion pass he didn’t get.

Couch did spending in December of 2014 to get a companion pass, but the points didn't post until January of 2015, so he didn't get the companion pass. Now he's suing. Link to the complaint here. So much for CP through CC...

I hope this doesn't change their strategy...
I don't think there is a basis for his case to stand. It's clear that the points need to post by the end of the calendar year.

Even if the terms are a bit misleading, common sense dictates this guy is an idiot.

Poetentially another CK situation here.

Sounds like he didn't qualify for it at all since his spending was credited the next year?

This is what really ticks me off sometimes. My FIL has Citi TYP, one day I decided to take a look at it and I had to sign up for online banking first... And I realized that he had 200k points expiring on him the last 5 years.. When I showed it to him he was really mad. He tells me,  they manage to send all kind of junk emails, all kind of promos which no body cares, but one single email saying that his points are about to expire they don't bother on sending out. Idiots.

Obviously this is a very stressful experience.
Keep in mind that the underlying basis for the entire miles game is that the banks and airlines can be very generous to 5% (read: people like us) because the other 95% will not make good use of their points. They might expire. Or die. Or close a card and lose the points. And a lot of people will redeem them for stuff like TVs or cameras or gift cards where the cpp is under 1.
