Crazy Summer Camp Contract
« on: April 13, 2015, 07:22:54 PM »
I just saw a contract for a summer camp and... wow, is this even legal? Check out this part

Staff Member shall not offer, solicit, or induce, either directly or indirectly, verbally, in writing or by any electronic transmission, including, but not limited to, texting, email, social networking, any of the campers, other employees or patrons of Employer for a period of three years after termination of this Agreement. This shall include, but not be limited to, encouraging campers or other employees to attend another camp, whether day or residential, or any other program, including any travel or teen tour program offered during the months of June, July or August.

Definitely sounds like they've been burned before.

Does that shed any light?

Does it also restrict you from opening a camp? If not this is a pretty permissive non-compete.
If you don't care why would you comment?

I have seen many no-competes, none like this.

But for 3 years? That means if I was a counselor there one year, and 3 years later I became head counselor in another camp I can't hire anyone who was there the same year as me...

I assume 3 years later would be fine

This is a little over the top. Try to strike through it and sign anyway. They may not notice.

Many non competes are not enforceable. Not sure about this one but if the pay is minimal it is very unlikely that a judge would let it stand

I've been in camps for 10 years and never saw something like this. Maybe if enough ppl protest it they will change it. It's just not right IMHO.

+1
legally they can put any clause in there, whether a judge will uphold it is a different story- , this one seems like it is worthless as it is clearly unreasonably broad, prob best to cross out the clause, often no one even checks if you modify language on these type of form contracts, if all else fails don't think there is harm in signing it if you have to.

I wonder what people who type "u" instead of "you" do with all their free time.

I don't get it, what's the news?  That a company put a strict clause into a contract, happens every second of every day.  At least take it up with them and give them a chance to respond or make changes before going to a news site.
