Yes because at least we didnt do anything that has a 49% chance of being wrong. We just left it as it was.

Why do you assume that is the halacha? I read the line of hamotzi m'chaveiro as referring to who must produce evidence to begin with.  But I don't read it as telling me what level of evidence is required.

So, what probability do you think is required in halacha?

The torah is the oldest legal system and most of the legal concepts we have today have a torah basis. So this has nothing to do with religion.

I hate the guy as much as anyone, but destroying a private phone which he has no obligation to hand over to his employer is hardly enough to suspend an employee. The NFL is trying to flex its muscles and show who is boss, but they are still very very much in the wrong.

There is evidence in the wells report, including the other side of the text messages to employees.  The phone destruction isn't evidence of the act of cheating, it's evidence of the offense of lack of cooperation in an investigation, which is in the CBA.  He's contractually obligated as a condition of his employment to cooperate with investigations of wrongdoing by his employer.

Of course he destroyed his phone.  You think he should have to turn over his phone? That's a serious privacy violation. You want to turn over your phone to your employer so they can read all your texts etc and find out what you're posting on ddf?

You think that includes giving over his phone? I'm sure you've signed plenty of agreements in your life that included "cooperation," and I'm sure you never wondered whether that included giving over your phone, or allowing them to search your house, or allowing them to interrogate your kids, etc.  The idea that "cooperation" includes everything you want from the guy is nuts.
