The Patriots did not cheat, and Brady did not cheat.

America minus Boston are sore losers.

I hate the guy as much as anyone, but destroying a private phone which he has no obligation to hand over to his employer is hardly enough to suspend an employee. The NFL is trying to flex its muscles and show who is boss, but they are still very very much in the wrong.

Is there any doubt that he cheated? No. Is there any evidence? No.
Completely not true he does have am oblation to turn over his cellphone. and if he had nothing to hide but just didn't want to give it over then at very least give it to his lawyer. Destroying it is pretty damming evidence.

You think that includes giving over his phone? I'm sure you've signed plenty of agreements in your life that included "cooperation," and I'm sure you never wondered whether that included giving over your phone, or allowing them to search your house, or allowing them to interrogate your kids, etc.  The idea that "cooperation" includes everything you want from the guy is nuts.
So don't give over your phone. Saying it's a violation of your privacy and unnecessary is a much more defensible position than destroying the phone. Not to mention the fact that his actual stated reason for destroying his phone is that he always destroys his old phone when he gets a new one (which was of course cast into doubt by the fact that they found a different older phone of his as well). The fact that he destroyed it indicates he didn't want people to know about it at all.

I'm not saying you're wrong in principle, just that it's clearly not what this was about.

+1, you beat me to it, at least the part about destroying vs not complying.

Of course he destroyed his phone.  You think he should have to turn over his phone? That's a serious privacy violation. You want to turn over your phone to your employer so they can read all your texts etc and find out what you're posting on ddf?

You think that includes giving over his phone? It does include giving over his phone and of he doesn't want to that's fine but accept the punishment for not cooperating.  Ands still gives no explanation for destroying it they weren't going to take it by force

It includes preserving data for a supervised viewing (which is what was arranged in this case) when you are explicitly asked to do so.  That's cooperation.  Had he destroyed the phone before being asked, I'd probably say it wasn't non-cooperation.

The idea that people don't understand how this is cooperation and characterize it as including everything the NFL wants from this guy is what is nuts.

Bradys whole argument here is based on technicalities. The fact is hes a cheater and should just take his suspension like a man.

Even Arod finally shut up and took it.

So if some rental car agreement you signed includes you cooperating with them, you would assume that includes giving them your phone for a supervised viewing? I sure wouldn't.

Good thing you're not a trial lawyer

I represent a lot of folks entering into agreements written by other people.

And a lot of folks writing those agreements.

Then you should know better than to compare a contract by adhesion and a union negotiated collective bargaining agreement.

In the ruling, Judge Berman puts "independent" in quotes every time he refers to Wells investigation. Nice.
