because if everyone that listens to their music would buy it then they wouldnt lose as much so in the long run

Then those claiming that the proliferation of copying increases exposure and ultimately sales are wrong. Is that what you mean?

Sales of CDs and legal downloads.

The argument I've heard made, which goes back to the days of the compact cassette, is that ultimately, the more copies (legal or illegal) that there are around, the more actual sales are made, because many people will like an album they heard from a friend's pirated copy and go buy it.

The same argument was made during the Napster debate, and I questioned then, that if the music industry actually ends up profiting from unauthorized copying, why are they spending so much on lawyers to shut Napster down? (If the profit ultimately came from concerts, they still wouldn't want to shut down a free PR machine.)

Yes, that's why that argument hardly makes sense.

My guess is that you're under 25.  Back in the good old days owning a cd/record was more than just the music, it was a way of following a band. Also the sleeves usually had some appeal.  Music fandom has completely changed. Now people no longer are fans of bands only fans of individual songs.

The argument is usually twofold: They lose sales, and artists stop producing new material because it simply ins't worth it if it gets stolen.

The second one has been summarily debunked, as a quick look shows musicians and movie studios are more prolific than ever. This argument is repeated often in the Jewish world, but again, I doubt its veracity. Albums have always been glorified business cards for singers to perform at wedding and live events. Only the top few have ever made money of CD/cassette/download sales. (And Eli Gerstner. I've heard it quoted that he consistently makes money on his productions. All I can do is scratch and shake my head.)

As to your question about sales, this is a question that has been asked by many. This debate was rehashed more recently with the proposed SOPA regulations. The numbers the movie and music industries produced were ripped to shreds by most third party analysts. I don't know why they do it - there may be a value in fighting it so it gets curtailed to a point, and they still get the benefits of pirating without all of the losses. It may be a visceral reaction -you would think that stealing=less sales by definition. The opposite is counter-intuitive. I'm sure there is plenty of evidence that I am wrong. But from what I have read, it seems the music and movie industries are making more content and earning more money since the advent of pirating.

Again: THIS IS NOT A JUSTIFICATION TO STEAL.

Yes, that's why that argument hardly makes sense.

I don't think the argument is that the piraters themselves become buyers, though that definitely does exist. I will often listen to a stolen copy of the CD before deciding to buy it or not.

Perhaps. Hard to accept, though.

Totally with you on that. I can't tell you how much money I've spent on music (Jewish) which I had access to copy.

True for some individuals. I meant as a mindset and culture, and on a broader level.

Let's face it, if most people in the world were faced with the moral challenge of not feely downloading from an easily accessible data base of music, such as Napster, would they pass?

As far as the continued success of the music industry, that could be attributed to the technology itself which makes not just pirating, but also buying music so easy and accessible.

That's generally true, but would you buy their next album?

I know by me there are artists who's albums I'll buy now only because I liked what I heard on a pirated copy of one of their albums that fell into my hands. If not for the pirated copy I probably wouldn't even know the artist existed.

Once you're getting a pirated copy of one album, why wouldn't you get a pirated copy of their next one?
Workflowy. You won't know what you're missing until you try it.

...a pirated copy of one of their albums that fell into my hands.
If I want an album I'll buy it. I'm talking about cases where I never would've bought the album, and wasn't specifically looking for it, but once I had it I liked it.

If it's an album that I would otherwise buy I won't get a pirated copy, but I guess I'm not quite at the level of buying a legal copy of something that I otherwise wouldn't have bought once I already have a pirated copy.

Anyone heard the new Ohad yet? On Mostly Music it's still pre-order, but I heard that Israeli radio stations are already playing the whole album.

One thing that looks funny is the cover. On top it says "Dovid Fadida Magish" and on bottom it says "A Yossi Green Production". I wonder who did more. Based on Yossi Green's recent track record (Shragee, Tzuddik, Yiddish Nachas), I would hope that it's more Fadida! (They happen to be nice CDs, but there's nothing exciting about them.)
mostlymusic.com has it now

I bought the Kumtantz DVD a couple of weeks ago and assumed wrongly that I'd get the audio for it too, do you guys think that it would be considered pirating if I get the audio only version from a friend?

Considering if you're good with a computer you could pull the audio from the video...I probably would do it-that doesn't make it okay though.
