This is interesting, because Roberts is making the slippery slope argument, and Kennedy is making the anti-slippery slope argument. But, they both seem to share the opinion about where the law should be in relation to religious groups. So what's stopping them from deciding that way if the issue comes up later? Ultimately, a theoretical remark by the Solicitor General doesn't have the force of a supreme court vote when the time comes.

I reread what Kennedy wrote. He's not making any anti-slippery slope argument. All he's saying is that the First Amendment allows religions to continue teaching their views on marriage. He's not saying anything that we didn't already know.

I'm not sure I would categorize the ruling as liberal. The court narrowed the definition of official acts.

Did they issue an injunction, or did they send it back to the lower court to reconsider? I haven't been following the case.

The October 2 order of the United States District Court for the District of New Jersey is vacated, and the case is remanded to the United States Court of Appeals for the Third Circuit with instructions to remand to the District Court for further consideration in light of Roman Catholic Diocese of Brooklyn v. Cuomo, 592 U. S. ___ (2020).

IIUC, it means the injunction denial was overturned and the lower courts should reconsider an injunction.

I think the case may be moot anyways, so an injunction was not really needed.
