Any news site would have done that, he's building a news site. Part of what attracts more people is the ability to post first and there's nothing wrong with playing it up. I'm not sure why something which was going to become public anyways needs approval from his family.
Definitely disagree. 1) they repeat a bunch of times in the same short paragraph that they are the first to report it...even for bragging rights and "building up your site" its excessive. And besides, it's the wrong issue to turn into a who-called-the-election-first thing. And 2) It would go public eventually, however, it had not yet. They were the ones breaking the news. It is a sensitive issue. In fact, in their own words "Shortly after we reported it, his wife, Esther Pollard, as well as Askonim involved requested that TLS take down the article due to its sensitive nature..." If as you say it was going to go public anyhow, why listen to them? Bottom line is that - especially if you are a frum site - the first thing that should through your mind is, let me run this by his family before I let the world know about this. It may be harmful if made public prematurely.
