The problem is that the feet aren't equal.

CMIIW, but how often do we see a D appointee voting the other way (like Roberts did with the ACA)? It seems like the D appointees are much more loyal to the cause of their party, whereas some R appointees, while conservative in nature, aren't 100% predictable. Can you show me a mirror image of what Sotomayor did? (I'm not saying it doesn't exist, I'm just unfamiliar and asking).

I love when others make my point. By enacting the nuclear option the R's will lose in the long run because of what you just stated.

I wasn't arguing with your point. Nuclear options definitely work both ways. But just like stated above with public unions, the politicians that did this won't be around when it's time for reckoning (and they are hoping now, that one side can be made stronger so the time of reckoning gets kicked off further into the future).

They say it very clearly in their opinions when they use reasoning similar to "unamerican"and other subjective reasoning. The conservative constitutional ideology is much more rigid in the actual language while the liberal ones are much more based on wishy washy subjective reasoning.
