Car Insurance Accident Claim Question
« on: September 21, 2015, 04:05:38 PM »
I was backing out of my driveway and a car came flying down the street and she kept on driving while I was backing out and we hit each other. Of course she came out screaming that I am at fault. I told her if she want's she can call the police. I am not giving her anything. She didn't do anything and just drove away. Today her insurance calls me up asking all kind of questions and asking for my policy info. Here are my questions.

1) Do I have to give my policy info to them? (if not, can they just figure it out themselves?)

2) Since there was no police report, is there any way that she can say that I am at fault and have my Insurance pay?

3) Will my insurance go up or since there is no report that I am at fault there is nothing I have to worry about?

if there is a security camera & she can get a hold of it.. it may be problematic for you

first off who hit who? Did the back of your car hit the side of her car or did the front of her car hit the side of your car?

getting hit in the rear is almost always your fault unless you can prove she was speeding or ran a light etc....

my rear left bumper hit the side of her car while i was backing out to the right side. My right bumper was out enough that she didn't even touch it! While i was already out of the drive way, way into the street she came flying down the street.

again why should i be at fault if i looked and no one was coming when i was starting to back out?

In any case, since there is no police report and no evidence is there any way she can claim something?

My understanding is that if you are backing up you are at fault, even if the other guy was speeding.

Same thing if you knock off someone door when they open it, it's not your fault, it's the person who opened up the door.

Yup always besides if you have proof that they were speeding. It's always the one who has the right of way.

What if both people are backing up?

eg: today i was backing out in a parking lot. I stopped to look both ways, and as I was watching, another car came speeding out of a spot opposite, and backed in to mine.

Who is 'at fault'?
Workflowy. You won't know what you're missing until you try it.

When I made research on a similar kind of accident the info I got was that the one who is going straight has the right of way.
