Baby born abroad to American citizen parents.

My wife just gave birth abroad (both parents are US citizens), Planning on flying back to the US in 4 weeks or so, can my child enter the US not yet as an american citizen, with a foreign passport, any make him an american citizen once we are in the US?

Your son IS an American citizen, no need to make him one. You may need a Certificate of Naturalization though. My parents got me mine at the American consulate, dunno if that's still the case today.

I'm a US citizen and I traveled with my son to the US with his foreign passport before applying for US citizenship for him.

IME it was easy to do abroad, but being a U.S. citizen is not enough for a parent (or even both parents) to give their child citizenship, you have to prove that you lived in the U.S. for some time (IINM it was 10 years, 5 of which were after age 18), I still have my thick folder with "evidence".

The following conditions affect children born outside the U.S. and its outlying possessions to married parents (special conditions affect children born out of wedlock: see below). If both parents are U.S. citizens, the child is a citizen if either of the parents has ever had a residence in the U.S. prior to the child's birth.

AFAIK it is illegal for a US citizen to enter the US on another passport. Of course if you listen to Kangarruu you have no risk. Otherwise they may choose to make it difficult for you... (which airport are you clearing customs at? ;) )

If one parent also enters the country on a foreign passport, they will have no way of knowing that the child is a US citizen. Of course this can only be done if that parent was not born in the US, otherwise you're back to square one...

-1, even if both parents are citizens but they're living abroad the child is not automatically a USA citizen, he must be registered in a consulate abroad where he was born.
2) It's only illegal to enter the USA on a different passport if you have a USA passport otherwise AFAIK it's not a problem.

It's only illegal to enter the USA on a different passport if you have a USA passport otherwise AFAIK it's not a problem.

Definitely if you had one that is now expired it is a problem.

If you guys are right, technically the child would have to have a return ticket within the tame frame a national of their country may be in the us as a tourist...

if the foreign passport requires a visa to enter the USA, you might have a problem. ex- israeli. But if your planning on getting the usa passport, just do it in Israel. i got a emergency passport in 24 hours, and they dont charge any extra for emergency passports. but i needs to be mailed in after you return, and they will replace it with a regular one.

I am almost done this crazy passport and my kid is 11 months. My wife is Israeli so my kid got an Israeli passport right away. I flew with the Israeli passport without a visa with a birth certificate on Delta but no other airlines would let us on the plane. The Lady at customs was not happy about it. Next trip to America they gave us a temporary passport since we weren't legally married at time of birth and we needed proof that either my wife spent 365 consecutive days in the US over the age of 16 or that I was there for 5 years. We couldn't prove any of that (my school didn't have transcripts) and they ended up taking the stamps in my wife's passport as proof.
If you are legally married you just need to bring your marriage certificate.
