I don't understand you people, are you really suggesting that doing damage to the car is better than having it ticketed and towed?

What if the car IS stolen, you are not doing the owner any good by not reporting it (unless the owner wanted it stolen).  I can not  believe there is a person in Brooklyn who would leave his driveway blocked for three days without doing anything.

You can't get in your driveway, call the police.  Believe me, whoever put the car there does not expect it to still be there.

Position wheel blocks either in front of or behind all four tires in order to safely keep the car in place. The Auto Car Repair website explains that not using wheel blocks or placing them incorrectly can cause the vehicle to roll forward or backward while it is being put into neutral. If the car begins to roll, serious injuries can occur if the car is not stopped quickly enough.
Turn on the flashlight and carefully crawl underneath the car with the individuals back on the ground. Use the flashlight to locate the vehicle's transmission. The Auto Car Repair website explains that the transmission is usually located near the engine.
Locate the cable that runs alongside the transmission. The correct cable has a switch and lever attached to it. Disconnect the cable and push backwards on the lever until it makes a clicking noise twice. The Auto Car Repair website explains that the lever should be pushed toward the back end of the vehicle.
Come out from underneath the car and push on the car without removing the wheel blocks. If the procedure worked correctly, the car should move slightly if it is in neutral. Once the car is successfully in neutral it can be pushed and moved to an alternate location.
this only works to roll the car (these instructions are for those who have access inside car but don't have a key)
Wheel dollies will enable you to  roll the car in any direction.

I may be asking the wrong question but, who leaves there car for over three days with the hazards on and doesn't come back for it... something is obviously wrong with the person...as in maybe he/she is the one in the hospital. Someone mentioned that he went to visit someone at a hospital possibly...Is there even a hospital nearby. Maybe its also just me, cause I live in the suberbs...but how do you function even one day without being able to take your car out.

Why is everyone convinced it's Jewish (even though only Jews would blocks driveway and expect the car to be there,) is there any 'Jewish' 'stuff' in the car?
What's your plan for yud shvat?

There is no problem according to Halachah to either break that guys car in order to get out or to call the police. End of story.

Tell your LOR to learn Chushem Mishput again

הממלא חצר חבירו כדי יין וכדי שמן: בעל החצר משבר ויוצא, משבר ונכנס That is what the Mechaber holds as well.
1) משבר ויוצא is only if that helps him go out of his property, breaking his windows won't help you move the car.

2) are you sure that blocking a driveway is the same as הממלא חצר חבירו?

It may not be but if it is in BP then the possibility would need to be considered.

I would like to take this moment to applaud Venilla's honesty and mentchlechkeit. Two wrongs don't make a right.
I will now continue to remain uninvolved.
*Blushing*

you should definitely not tow it. let me take care of it for you... i can also use an extra spot...  :P
Cute sarcasm but it's irrelevant. I'm definitely not the one who doesn't stick out for my rights but if it's not halachaglly allowed I can't tow it.

And if it stolen and listed they'll also find out when the give the ticket.
I have no reason to think it's been stolen.

Why is everyone convinced it's Jewish (even though only Jews would blocks driveway and expect the car to be there,) is there any 'Jewish' 'stuff' in the car?
Everybody is convinced because it was understood from my words. I'm convinced because
1) It's leased thru a Jewish leasing company.
2) There's a tfilas haderech hanging on the mirror.
3) There's a hat in the car.

@ iherman, it's not as simple as you make it sound.

I asked a few C"M Dayanim,

1st, didn't wanna answer.

2nd said, the ticket is a fine and won't be considered as a cost of getting access to my property (if I'm willing to pay the ticket I can have it towed on the owners expense).

3rd said that the halacha משבר ויוצא is only if there's no other way to remove it without major tircha -what's called major/minor tircha is for a dayan to be considered- including to find out who's car it is and give him notice.

I believe you've also asked a reputable dayan, I don't know if he gave you a general psak or he answered on a specific story. but I don't know how you can say on a dayan that he'swrong when it's not even you who learned halacha -to an extend that you're able to pasken- just because you have gotten a different psak. (maybe you are a dayan? 8))

Why are you so confident that the psak you've gotten implies in all circumstances? and even if it does, why are you so sure that the dayan you asked has gotten the right psak?

The end of the story,

I called up the leasing company where the car was leased and asked if they have the phone number of the owner, I gave the plate number and they were able to locate his contact info.

I called up the number, a real old guy picks up the phone and I ask him, are you the owner of a blue accord?

Him:Yes.

Me:Are you doing fine?

Him:Yes, what's the matter?

Me:Do you know you're blocking a driveway for 3 days?

Him:Oh! you're serious?

Me:Yes I am, would you come move your car?

Him:I'm out of town, I went to Baltimore to my kids, oh my! I'm so sorry I really didn't notice there's a driveway (I don't know how it can be foreseen, I guess I'll understand when I get older :) )

Me: I have 2 options for you, I can have the vehicle towed and it will cost you about $300 or I can move it with a few jacks but I take no responsibility if your car gets damaged.

He chose the latter, we had a nice conversation and I moved the car.

I'm glad I didn't tow it, that old guy really seemed to be innocent and it would've take him forever to locate his car.

Before addressing the arguments you raised, can you share who the CM poiskim you spoke are? I posted a name upthread of one of the most prominent CM Dayunim who I took my Pesak from.

Any mention of the hazard lights being left on? Or just another sign of old age?
Does he live near you?
