It is my understanding that unless they prove that the Brady violation was intentional, they can't get anything. But they are trying to get documents that may be able to prove it, and the prosecutors are trying to not hand it over, but the judge ruled that they have to hand it over. That ruling was on hold, but is now back in effect after the appeals ruling.

Final words of the opinion posted above: Accordingly, we see no basis to disagree with the motion judge that the State committed a Brady violation because it denied defendant his constitutional right to a fair trial in not disclosing Exhibit F.

Elizabeth has a very large frum community for many many years including Rabbi Teitz.
Linden is growing very fast, but I'm not sure how many live in Roselle.
Union has a yeshiva (The former Linden Yeshiva) and a small bobov community.
Lots of frum people in the whole area. Linden, Roselle, Rahway, Union, Clark, etc.

It seems like it will be very hard for the prosecution to make a case at a new trial. They have to prove that he committed a crime and was covering it up with this transaction, but can't argue that he stole money, since he was found not guilty on those charges.

Also would like to point out that there were 3 judges and they unanimously made this decision to side with Paone, the deck is stacked against the state now.

BTW, for those reading the brief, there is a factual error in the brief. The court writes that Rabbi Eisemann was a partner in TAZ. That is incorrect. It is based off a heter iska that is written as a "partnership agreement." In truth, Rabbi Eisemann had no ownership in TAZ. Not sure it makes much of a difference at this point, but just wanted to set the record straight.

The State seemed to be literally looking for something to catch him on. Such krime lomdus and rule-making to punish him with no real evidence of any crime.

We now have 4 judges and 2 state senators that believe there was severe prosecutorial misconduct (or a very high chance of it). And it’s getting more egregious and blatant by the day.

At what point should there be a state investigation into this matter? What does it take to get the ball rolling?

To clear themselves? They should have dropped the case much earlier. By now, the cat is out of the bag. Anything they do now is just digging their hole deeper.

100%.

If this doesn’t call for an investigation, what does? How long can prosecutors just do whatever they want? Is there any oversight? If this panel of three judges thinks there was a Brady violation and if the Judge Paone thinks there was a Brady violation, shouldn’t this be thoroughly investigated? How are people supposed to trust the justice system when it looks like the prosecutors are running rouge?

I just read through this and it infuriates me. How is it possible that United Sates justice system allows for a prosecutor who has an agenda to bankrupt and ruin an innocent mans life and face no repercussions when caught???

Shpitz success for a prosecutor is when he can turn a minor crime into a many years sentence. And they sleep good at night afterwards. The justice system is full of heartless cruel self advancing people dressed in fancy suits.
