I got the phone and from the serial it doesn't look refurbished, plus the original box has the sticker with the same serial. I'm thinking that it might have been a return that was cleaned up since the warranty expires in July 2017. It is still a good deal so I will keep it, but I will definitely try to get a partial refund/GC from Walmart.

1. Many of the complaints (here) about Jet have been about the 3rd party sold items
2. Many buyers don't know the difference between Amazon and 3rd party sellers.

But the main reason why Amazin is slimy, and far worse than the others:
3. It's amazon's brand and they are actively helping the Chinese set up their accounts and scam customers in unheard of numbers. Chinese sellers have to literally murder 10 customers before they get suspended. That seller is just one of the thousands I've seen (and part of the tens of thousands I haven't seen) that are scamming customers all day long. It is slowly killing amazon's reputation, and Amazon couldn't give a darn. Walmart and Jet haven't done anything like that. Maybe when they grow bigger they will do the same, but as it stands right now, amazon and ebay are the dregs of the ecommerce world.

Chatted with a CSR and was offered a 10% refund. Told him I wanted more so he said to email help@walmart.com. Even with screenshots of website, email confirmation and order status they maintain that it is a refurbished phone (it doesn't state it), and they gave me 10% off. I will keep it for this price as it is a great deal with the warranty until July 2017, and it is safe to assume that it was a listing mistake.

I was emailed by someone in the corporate office. This was their response after sending them my email confirmation and screen shot of the website. Note how she says that what I ordered was a refurbished phone!

I am not suggesting to do so since it would be ethically wrong, but I was wondering what would be the legality of a chargeback in this case? Meaning would mentioning it scare them?

It does but the on the apple website it says it isn't a valid serial number.

If the serial # starts with a S on the sticker on the back then don't include it.
