American Express has agreed to settle a class action lawsuit that accuses it of violating the Telephone Consumer Protection Act (TCPA) by using an automatic dialing system, predictive dialer, prerecorded or artificial voice to call consumers without their consent.

If you received automated calls on your cell phone on behalf of American Express between July 3, 2009 and Mar. 15, 2016, you may be entitled to compensation from this TCPA class action settlement.

Plaintiffs Jennifer Ossola, Joetta Callentine and Scott Dolemba allege that a company called Alorica Inc. placed calls to consumers’ cell phones on behalf of American Express. These calls were reportedly made with the purpose of marketing American Express small business credit cards to potential customers.

According to the telemarketing class action lawsuit, these calls violated the TCPA, a federal law that prohibits companies from using automatic dialing systems, predictive dialers, prerecorded and artificial voices to make calls to consumers without their prior express consent.

American Express denies any wrongdoing, but the company agreed to pay $8.25 million to settle the TCPA class action lawsuit.

If you would like to exclude yourself from or object to the American Express class action settlement, you must do so no later than Oct. 3, 2016.

Who’s Eligible

Class Members of the AmEx telemarketing settlement include:

“All persons nationwide within the United States who, on or after July 3, 2009 through March 15, 2016, received a telemarketing call from Alorica Inc. (or its agents or affiliates) on behalf of American Express, in connection with the marketing of American Express small business charge and/or credit cards to potential customers, to a cellular telephone number through the use of an automatic telephone dialing system, predictive dialer, and/or an artificial or prerecorded voice.”

Potential Award

At least $50 (estimated).

The amount of compensation each claimant will receive depends on how many Class Members submit timely and valid claims.

How am I supposed to remember?

If you can't remember, it didn't do $50 worth of damage to you.

That's not really the point, once the class action is won, if you were affected, you're entitled to payment.
