Car Accident
« on: October 29, 2016, 08:15:26 PM »
I was in an accident yesterday where the guy in back of me slammed into me causing me to hit the vehicle in front of me.
Who is at fault for hitting that car me or the guy who hit me?

If the facts are not in dispute, he is. I'm not a lawyer, but that was my experience.

It wouldnt be a case if it wasnt in dispute. he said I hit car number 1 first which caused him to hit me. There was very little damage to car number 1. Mine is prob totaled. Front and back all smashed up

If you filed a police report you are good. The guy behind you is always at fault no matter how many people get hit in front the first guy to cause the pileup is at fault.

I have been told that the back guy is always responsible for everything that happenned in front of him.

What does the police report say? That's all that matters.

Not necessarily. If the PR is clear, would they still argue?

Even were it true that you hit car 1 first, he clearly wasn't keeping his distance enough from you, so even according to his report, he's responsible for colliding into your car.

-1
As by hitting the car in front, it caused you to stop without brake lights. Now middle car is at fault.

I'm guessing if me damage in back,  they'll conclude that was the first impact.

Who said brake light weren't on? He could have hit him while braking.

-1 from experience. I had a police report which clearly indicated that the other party was at fault, and the insurances still fought it out. It took about a year to get my deductible back.

I had same exact story as OP. PR was a complete contradiction...

In the end they gave me 40% fault and the rest to the car in back of me.

I could've fighted it but problem was that we both had same insurance company so they rather fault both...
