Israeli compensation vs EU compensation question
« on: November 01, 2016, 12:41:38 AM »
Flight was JFK-BCN-TLV.

Got stuck in BCN overnight due to mechanical issues with the ElAl plane BCN-TLV.

Can I file for compensation under the EU law? Israeli law? Neither? Both?

Thanks!

both as eu law is for every flight leaving the eu and the israeli law is for every elal flight but they will likely only give you one of them not both

Question is if a connection qualifies as leaving the EU.

its counting by the flight, not by the origin of the passenger.

Are you sure? I know that they count total miles of the trip to determine compensation amount.

How about JFK-FCO-TLV. (AA and Elal) first flight delayed 2.5-3 hours due to mechanical issues, due to that missed connection flight. was rebooked on a 10 hour later Elal. arrived at destination 12 hours late.

Is this Considered a delay of 12 hours?

Can I file for compensation under the EU law? Israel? Dot?

If any what's the best?

Thanks!

4:05 scheduled departure, actual departure close to 12 am.
Does Israeli law cover?

I was just asked a similar question by my niece who had such a situation with IB (all flights IB).

I didn't have time to research, but I recommended she send a request for compensation to IB. Israeli law actually requires the travel agent to facilitate such a request if asked by the client. I therefore suggested that she ask the travel agent to file for compensation for her.
I've been waiting over 5 years with bated breath for someone to say that!

Israeli law does cover, IIRC you are entitled to ILS 3120 + expenses (food, etc). They must pay within 45 days of receiving your request.

Not sure about Israeli law, but that should definitely qualify for EU compensation rules as IB is an EU based carrier.

That is per pax. If purchased in Israel via a travel agent, just ask for them to handle for you (required by same law). Otherwise write directly to the airline.

Dose EU Law go by actual carrier operating the flight, or by the airline on itinerary? (e.g. Iberia flight xxx jfk-fco operated by AA)

Is it different for Israeli compensation law?

What if it's a BA ticket, with some segments operated by AA and some by BA?
