Rental Car Company Says Their Car Was in Accident With Me

I wasn't sure where to put this as I was not the one renting a car. The guy renting the car was the one who hit my car.

Basically, my wife was out driving our van and she took a right turn and some guy tried to squeeze by next to her on her right and didn't make it and they traded paint. She exchanged information with him and he said to her, "Don't worry. It's a rental. I have insurance." I called my insurance broker (not company) that very day and they said do nothing, just wait. That was 2 months ago.

So today I get a letter in the mail from Enterprise. It's addressed to me, not to my wife. It says:

Dear Sir/Madam:

This letter is in reference to the above captioned claim wherein you were involved in an accident with our vehicle. After careful review of the facts of this loss, our initial investigation has determined that you may be negligent and therefor responsible for our damages.

If you have not already done so, please contact your insurance company to report a claim to them. Once reported, please contact us to provide your claim information.

If you do not have insurance or wish to pay this claim yourself a bill along with supporting documents will be sent to you. If you have any questions, blah, blah. blah.

I called my insurance broker (not company) and they said that if I wasn't at fault why would I open a claim.

Personally, I think they are just fishing for easy money. Plus, what kind of chutzpah is that for them to tell me to make a claim? That's none of their business. I am tempted to either throw it away or send them a letter from a lawyer saying that they should take me to small claims court.

Any advice?

People used to get into accidents before smart phones too.

Yup. Insurance fraud is an old trick when you tell someome don't worry my insurance will cover it and then they say you were at fault.

Smartphones are just an easy way to solve that problem.

They used to call cops if they couldn't get written statement.

No, my car already has scrapes so I ignored the bit of paint the other car left on it.

Do you have any witnesses?

I wasn't even there. It was my wife who it happened to. The guy who sideswiped her was alone too. It's his word against hers.

So just ignore it for now. They'll seen proof if they have.

My hunch (just based on my knowledge of "things") is that this is a standard letter they send out just to see if they can make an easy score. They have no proof. They have nothing. But if their letter rattles me enough then I make a claim with my insurance company and then the rental company and them come to a settlement, or even better (in their perspective) I just pay the bill so I don't have to make a claim.

Like, what are they gonna do? How can they legally get any money from me? They'd have to take me to court. And that's why they send out these letters and I bet they WORK at least half of the time!

Just my hunch, but would love an experienced opinion.

Either way doesn't matter. Bottom line is just don't do anything at this point.

Especially if it wasn't sent certified.
