The CI is forced to differentiate because otherwise the sugyos contradict. That dues not mean that others can't hold of the same distinction. That can be what makes it Derech bishul or Derech hatmana

No. The CI differentiates between hatmana in a kli, and in the ground, so the question doesn’t start according to him. So I’m not sure what your are talking about.

Because only according to the CI is it a מחלק, everyone else equates them להלכה so it wouldn’t help to answer the question.
