Obviously they would see that the item was new when they got it back in the mail, I even wrote to them that they were free to reject the claim if they saw it wasn't.

I bought a dress, it was a final sale from couturecandy. I took the chance cause I thought if anything I could file a claim with Amex. I filed a claim and it was denied because its classified as formal wear. Can I appeal this ?

No-- fans heaters all seasonal items have a long use maybe 3 months or more depending where one lives -- formal-wear , wear one time - most woman will not wear 2nd time and most men have little use for a tuxedo

Please be advised that there may be an applicable statute of limitations that may bar your rights
in the future. Please refer to your Certificate/Description of Coverage for details.

Is it standard message or flagged? I didn't see it earlier when I made a claim on another item about 4 months back.

Correct. Not done any more this year. Total claims not even exceeded $200 on this card.
