What is custom? minhag. What is minhag? not halacha. Sometimes minhag mevatal halacha. So obviously they are not one and the same. So minhag is not meikar hadin, its a chumra. What else can it be?

Let me postulate this argument...if that was the custom in the dark ages (the times of the Trumas Hadeshen) we can say that it was a minhag. The unwashed masses were spreading the Black Plague, the Jews could go unwashed for 9 days and no one would notice. Today, when it is not acceptable to be unwashed for several days that minhag is no longer relevant or wise. Running water yochiach. You have a reliable posek in R' Ovadiah that says that its not acceptable. Who cares Sfardi or Ashkenazi.
