I may have missed it mentioned earlier, but it seems that only Dan thinks DE is at all related to chalav stam issues.
It's actually Minhag Chabad to be Makpid even on Keilim of Cholov Akum...

In Igros Moshe he writes that those who are machmir should be machmir on keilim as well.

Maybe there is milk that had the lactose removed? Or some other dairy product without lactose?

I called the OU. They told me it's D because they don't supervise the cleaning process.

I check the allergy warning periodically to confirm that it doesn't have milk.

Ask a shaila if checking the allergy warning suffices. I have heard from many sources that it doesn't because there are different rules in halacha and in US food labels about what has to be reported/what is an issue

Re orios, I know from a mashgiach to a orios factory that it is parave.
The mashgiach himself when ever he goes, plays with the oven (to make that batch pas yisroel) and then takes some home to eat.

Parve, pas Yisroel Oreos? Which city? Can he make a big batch; sell to distributors?

He does it for himself. Brings home a few packs. I tried then and honestly can't tell the difference between orios and the paskez copy

You can call the OU hotline and they will tell you the the Oreo regular and double stuff are pareve. They won't commit to the other varieties.
The Oregon/Washington Oreo plant has many more varieties which are pareve - not even DE.
The reason that the OU classifies them as D is because Nesbit submits a list of potential ingredients (schedule A) to the OU and lemaase they only use a small percentage of the ingredients on that list. The only way to find out the current ingredients is to go to the factory and check. Since the Oreos do not need hashgacha temidis - the OU doesn't want to label them as Pareve since Nesbit could change the ingredients to other ones on the approved list.
Fascinating topic though (-;

ok - Wondering what city, though -  Maybe Paskesz does the same and sells their's as private label. Do they both list same city on the packaging?

definitely fascinating; Still wish we'd hear a more straight answer from the TJ's choc chip companies.
Their lines are OK-Dairy with all Pareve ingredients.
I keep hearing that it's not just because they are being made on Dairy equipment, however somehow there is a risk of actual milk contained in them. But, it's non-dairy....

Meinyan leinyan, I think mashgichim should get together and publicize a list of which products with a "heimishe hashgacha" (eg pashkez libers etc) are actually a exact duplicate of a popular brand, just with their own sticker, so that we won't need to pay extra for their stickers..

Good idea -- A public, updated online list.

Even if it is now that can change in a heartbeat. A heimishe hechsher will often check over all the then current ingredients even if they don't change anything else. If they don't do that you shouldn't be paying for their label either way. That can change with the manufacturers next shipment. They also will sometimes ad some chumros to the production. This us what Leibers does when making potato chips at Wise. They kasher the friers and change the oil then have a yid turn on the fire for bishul Yisroel.

1) there was such a list that was compiled but it was quickly withdrawn after the heimishe companies and hechsherim made a huge fuss about it! (rightfully so)

2) there is a list somewhere out there of a number of pas yisroel items that are not marked pas yisroel but are truly pas yisroel

3) it is the common practice of any company that produces the same product in a number of factories to put a dairy on ALL of them even if only one of the factories is de in order to avoid having to print any new laels
