Supposedly the "justification" for SMRs sentence was the amount of losses incurred by the banks.

Seems like here despite a much larger amount, sentence is shorter. (Besides for other striking differences).

Never heard of this judge before. Does she have a history of giving Jews harsher sentences? If so was this brought up on appeal?

I don't know how many Jews were sentenced by her. It's not like she was a judge in the southern district of New York.

But her actions on the Rubashkin case scream louder than anything else.

If you are going to make a claim someone is an anti-Semite you should have some facts to back it up. If you are going to condemn her then you need to condemn our entire legal system. All the way to the SC agreed with her.

Not wanting to overturn a judge's action doesn't mean agreeing.

One doesn't always get justice out of our legal system, but a system is in place, and once something is done, overturning it is something that has a higher burden of proof.

As I said, I am not going to prove anything, and I don't know if it can be proved, but using the duck analogy.... even if it's only on one case.

If you are only going to use one case then you have no case. Were the prosecutors also anti-Semites? Weren't they also going to ask for life?

This would be a better argument for giving longer sentences but a weak one at that. Pretty hard for the limited amount of cases she had to effect the stock price.

Indeed, we focus on the fact that he's out. The case is not going to be retried.

I think you will have a hard time convincing people around here that Linda Reade isn't an antisemite. I am not going to argue facts, it's just the smell test. This is not a court of law where a presumption of innocence exists, and one is innocent until proven guilty. This is the court of public opinion, backed by thousands of years of experience. And since there's no earthly court penalty for being an antisemite, there isn't a requirement or a burden of proof.

If the facts say otherwise I would go with the smell test also.
