okay lets be clear the president can nominate whenever he wants ( right or wrong )the senates can do whatever they want ( right or wrong ) only problem i have is when they claim to have higher motives then just politics and dont want the political ramifications for their actions be what they may be

It would be a political stunt for Trump to nominate Garland if he loses the election. Democrats all yelled that he was a great choice, so it would look strange if they backed down on it...

The current goalposts are that POTUS has the right to choose whether or not to nominate and the Senate has the right to choose whether or not to take up the nomination. Exactly as prescribed by the constitution. The practical ramifications are the above. Anything else is just political spin including this.

I'm genuinely curious what would happen in a case where Biden wins the presidency but Republicans keep the Senate (probably the most likely scenario based on today's polling).

I assume the senate would have to hold hearings, but you never know.

I don't think they would be able to get away with that politically. The same question and answer goes for if Trump wins and the Senate flips. As a practical matter I think the Ds would be more likely to feel they can get away with not taking it up than the Rs but I don't think they would be right about that.

If he loses the election, he may just have a total meltdown and completely overwhelm Twitter's servers. Forget about him even pretending he's running the country.
Also, the R's aren't interested in Garland. They're not going to nominate him just to stick it the D's if they think they can get someone better up there.

You can laugh, but unless you tell me otherwise, I still think it's a smart move.

Republicans would know that if they don't act fast, a hard leftist will be nominated (assuming that Biden will get the Senate along with presidency). They would rather Garland than a hard leftist, so they would push him through quickly, and their justification would be that the Dems all thought he was a great choice 4 years earlier.
