If aguda somehow gets the courts to rule that zip code based restrictions are unconstitutional the government will simply find another way to accomplish the same measures.

Incorrect. In simpler terms, they were forced to have the same guidelines for shuls as they would for other similar situations. To my knowledge they have followed that ruling since then, including here. Some want to argue that restricting zip codes based on positivity rates is also discrimination against Jews but I fail to see how that is a coherent argument.
