Do you think rightly or wrongly so?

I skimmed a few articles about this but none of them discussed the legal issues involved. I could be wrong, but my gut instinct is that the verdict was political.

From what I heard on FOX it was 100% correct based on the facts of the case.

The question is about involuntary manslaughter, definitely enough reasonable doubt for it not to be murder.

People hammer juries in these high profile cases, but the burden of proof is very high. Casey Anthony, Trayvon Martin, OJ Simpson, et al - just because you believe the guy or gal did it, doesn't mean there isn't reasonable doubt for a jury to acquit.

He claims the gun went off by itself. She was killed by a ricochet. Pretty hard to get a conviction on that one.

FOX keeps trying to bring in he was deported 5 times like that has anything to do with the case.

Not so simple, Involuntary manslaughter means killing someone when committing a crime. Intent is irrelevant. Having a gun was a crime. The gun killed her. I am not a lawyer, but that's what I have been reading.

Again he claims he found the gun wrapped in rag under where he was sitting. When he went to unwrap it the gun fell and went off. Don't shoot the messenger.  :)

Right, but the jury has to believe his story is true. The bullet undoubtedly ricocheted, so a murder conviction was unlikely, as the accidental story is plausible. Less plausible is finding a gun in a rag and having it go off and kill someone. Unless you're in Chicago where that kind of unlucky magic happens all the time.

They don't need to believe it. They need to believe he did this on purpose. Without no evidence (no motive) how are they going to convict?

No motive or intent required for Involuntary manslaughter

What crime did he commit while the gun went off. They couldn't tie him to the gun which was stolen from a law enforcement car. That's the guy they should charge.  :)

Not when you pick something up and don't know what it is.

The bottom line is if it was a nice Jewish boy in this situation he would have never been charged.  ;)

Again, if you believe his story.

A murder charge, no, but a lesser charge? Probably. It just wouldn't be a big story.

H*ll no I don't believe him for a second. Unless you give me evidence to believe that says something different I would have to vote not guilty.
