if you still have not closed your cards it may be worth it to pay the fee and then wait till close to 60 days to call and cancel and have them refund the annual fee. it may cause it to show up in the system that the fee was paid

The burden of proof (if they even need one) is just preponderance of the evidence - that it is more likely than not that you sold points. It's not a really high bar. A few tickets to or from different accounts is probably enough.

You have it all wrong. They don't need to prove anything. It will be you that will need to take them to court. If it came to that would you lie in court?

Personally I wouldn't, but a cash transaction I don't see how it can be proven. In either case its not worth the time in court over a few points..

Not sure what the ftfy was for. Like I said, the data points all pointed to them not doing clawbacks. Now they do. And it was not entirely unexpected to begin someday.
