Even states that have a law in place making it illegal likely allow where there's a danger to the mother. As far as what's considered a danger probably differs from the law to halacha..

The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights.

I think the "setting expectations" argument is weak. The court was widely expected to overturn Roe since the oral arguments.

It was leaked to Politico, which implies that one of the left leaning judges (or their staff) shared the draft in order to fire up protests. It was a good idea and it's working. The backlash may influence the final opinion.

As I understand it, all we know for sure is that at the time of the original vote there was at least five votes in favor of overturning it.

The reason people are assuming that Roberts was not on board is because he did not write it and the Chief justice will usually assign the opinion to himself when he is in the majority.

The Supreme Court released a statement stating that the leaked report is indeed authentic, but adding it does not represent a decision by the Court or the final position of any member on the issues in the case.
